6. Restriction:

10. Customers with account sudo.ingo

a. Username / Password: Certain services available on the Platform require creating an account or require you to provide your Personal Data. If you want to create a sudo.ingo account, your Username and Password can be: (i) determined and given by us to you; or (ii) you specify / provide and are accepted by us based on our absolute policies regarding the use of the Service and / or access to the relevant Platform. 11. Kekayaan Intelektual

Restricted Use: No part of the Platform or Material can be reproduced, engineered, decompiled, disassembled, separated, modified, distributed, republished, displayed, broadcast, hyperlinked, mirrored, framed, transferred or sent in any way or stored / installed in an information retrieval system or installed on a server, system or equipment, without our prior written permission or from the copyright owner concerned.

12. Deskripsi Layanan/Produk

a. sudo.ingo menyediakan Layanan Website Toko Online dalam bentuk Paket yang berisi system website(CMS), nama domain, hosting, manual book, dan template berlisensi;

b. sudo.ingo memberikan fasilitas kepada Klien sebagai berikut:

• BackOffice untuk mengelola content & product toko online.
• Email Domain website.
• Data transfer yang terukur.
• Hosting sebesar Paket yang diambil. Besar space sesungguhnya lebih kecil daripada yang tercantum dalam Paket karena sebagian terpakai untuk script website (sekitar -+80MB).
• Untuk fasilitas pada butir-butir di atas dapat berubah sewaktu-waktu.

c. sudo.ingo tidak memberikan script aplikasi Toko Online dan tidak menyediakan control panel hosting

13. Penggunaan Layanan

a. Klien dilarang menggunakan Layanan untuk menampilkan atau menjual atau meletakkan file atau apa pun yang:

• Menyinggung Suku, Agama dan Ras (SARA) tertentu.
• Bersifat pornografi termasuk video, gambar, dan tulisan.
• Bersifat pembajakan antara lain lagu, film, program dan hal-hal lain yang melanggar ketentuan hukum Hak Atas Kekayaan Intelektual (HAKI).
• Melanggar UU yang berlaku di Negara Kesatuan Republik Indonesia.

b. Melakukan spam, mailbombing, dsb.

c. sudo.ingo berhak untuk menghentikan Layanan secara sepihak jika Klien:

• Menggunakan memori/RAM/CPU diluar batas kewajaran;
• Mengganggu kegiatan user lain di server;
• Melakukan kegiatan lain yang mencurigakan dan/atau tidak aman (meningkatkan resiko terbobolnya account/server).

d. sudo.ingo reserves the right to move the Client's hosting account to another server for the purpose of maintaining server stability and performance, emergency server replacement, or other purposes. This transfer will be notified as much as possible to the Client in advance, or if not possible, immediately thereafter. sudo.ingo will try its best to move all data and Client's hosting account settings to the new server.

14. Pembatasan Tanggung Jawab sudo.ingo

a. sudo.ingo tidak bertanggung jawab untuk mengisikan website Klien.

b. Domain:

• sudo.ingo is not responsible for Client domains that cannot function due to Client negligence, domain hijacking or late payment from the Client.
• Domains that the Client registers through sudo.ingo are only borrowing, not ownership, so if at any time the Client's domain can not be used for whatever reason it is not the responsibility of sudo.ingo because in this case sudo.ingo is only as an intermediary (helping to register the domain ) which is then used by the Client.
• Domains are registered through sudo.ingo and the client stops subscribing, so the domain has not been the responsibility of sudo.ingo since then.
• The domain that the Client registers must comply with all the conditions set by ICANN as the domain organizer.

c. Website content: sudo.ingo is not responsible for:

• keakuratan isi website Klien;
• hal-hal yang timbul akibat isi website Klien;
• hilangnya isi website Klien meskipun pihak Hosting telah melakukan backup atas seluruh data server.

15. Biaya dan Pembayaran

• Biaya Layanan yang akan dibayar oleh Klien sesuai dengan jumlah yang telah disepakati Klien dengan sudo.ingo;
• Klien wajib melakukan pembayaran sebelum Layanan dapat digunakan;
• Klien wajib melakukan pembayaran selambat-lambatnya 1 Bulan sebelum batas waktu berakhirnya Layanan untuk memperpanjang Layanan;
• Apabila dalam waktu 14 (empat belas) hari kalender terhitung sejak tanggal masa berlaku usai, yang tertera pada tagihan yang dilakukan sudo.ingo baik melalui e-mail dan/atau cara lainnya, maka sudo.ingo tanpa pemberitahuan lebih lanjut berhak menghentikan Layanan.
• Biaya transfer antarbank ditanggung oleh Klien, termasuk apabila mengajukan proses refund di mana rekening penerima tidak menggunakan Bank yang sama dengan sudo.ingo.

16. Pernyataan dan Jaminan

• Klien menyatakan dan menyetujui bahwa Layanan yang digunakan merupakan tanggung jawab Klien sepenuhnya;
• Klien menyatakan dan menyetujui bahwa uang pemesanan jasa/produk di sudo.ingo yang sudah ditransfer tidak dapat dilakukan refund apabila pemesanan website sudah diproses;.
• sudo.ingo tidak bertanggung jawab atas segala kerusakan yang diakibatkan penggunaan Layanan oleh Klien atau kehilangan data yang disebabkan penggunaan Layanan oleh Klien;
• Klien akan bertanggung jawab atas kerugian yang diderita Klien atas hal-hal tersebut pada di atas tidak akan melakukan tuntutan dalam bentuk apapun kepada sudo.ingo;
• sudo.ingo akan menggunakan alamat e-mail Klien untuk menghubungi Klien mengenai layanan yang sudo.ingo berikan/akan diberikan, juga memberitahukan tentang pembayaran atau pengumuman penting tentang Layanan;
• sudo.ingo tidak memberikan jaminan bahwa situs dengan tingkat trafik tertentu dapat ditanggung oleh server;
• sudo.ingo tidak dapat memberikan kompensasi apapun, jika terjadi gangguan pelayanan dan/atau kerusakan data dan/atau kehilangan data Anda oleh sebab apapun. Namun kami selalu berupaya untuk memberikan layanan yang terbaik bagi klien kami;
• sudo.ingo tidak bertanggung jawab atas semua kerugian secara langsung maupun tidak langsung karena kehilangan pendapatan atau keuntungan nyata yang diharapkan Klien maupun tuntutan pihak-pihak lain akibat terputusnya Layanan sudo.ingo.
• sudo.ingo berhak menolak memberikan Layanan pada calon Klien.

17. Dispute resolution

All disputes that arise will be endeavored to be resolved by deliberation to reach consensus.

18. Change

• We reserve the right to revise the guidelines, notices, operating rules, policies and instructions at any time and you are deemed aware of and subject to any of the changes above without prior notice.
• The Terms of Service and their changes are fully binding.
